Jose Ibarra was the accused killer of 22-year-old Laken Riley, a nursing student at Augusta University. He waived his right to a jury on November 12. Ibarra, here illegally, was arrested the day after the body of Riley was found. He faces a ten-count indictment, including charges of malice murder, kidnapping, aggravated assault, and tampering with evidence. In addition, he is being charged as a “peeping Tom” for an incident earlier that day, in which police say he peeked through a university residence window.
At the pre-trial hearing, Ibarra’s lawyers filed motions to suppress evidence of DNA and a cell phone. The court determined that the DNA and cell phone evidence would be admissible at trial. Ibarra also tried to get the “peeping Tom” charge severed from the rest of the charges. The court rejected this motion, reasoning that the two incidents were closely related.
The tragic death of Riley has both political parties using the event as leverage to draw attention to stricter immigration policies during the illegal immigration debate. Prosecutors will move for a life sentence without parole, but the defense has been making an adamant case that Ibarra was innocent.
Now, the bench will present the results of the trial, where the judge will decide the case as it warrants innocence or guilt. The whole process will begin on November 15. The case, however, has shocked the community since Riley was a popular student at Augusta University, and her death caused many concerned people about safety on college campuses.
